Annual Leave

All permanent full time and permanent part time (and fixed-term contract) employees are entitled to a minimum of 4 weeks paid Annual Leave after a period of 12 months continuous service. Any unused annual leave that has accrued for an employee carries forward from year to year, until it is taken. paid by agreement with the employee, or is paid out when the employment terminates. Note that there are rules for paying unused annual leave,

Annual leave accumulates from the first day of employment, even if an employee is in a probation period.

Annual leave also accrues to an employee during the periods that they are taking:

  • paid leave such as paid annual leave and paid sick and carer's leave;

  • community service leave including jury duty; or

  • long service leave.

    However, Annual leave does not accrue to the employee when they are taking:

  • unpaid annual leave;

  • unpaid sick/carer's leave;

  • unpaid parental leave; or

  • unpaid family and domestic violence leave.


The Australian Government's Paid Parental Leave Scheme is not considered to be paid leave. Therefore, an employee does not accrue annual leave while being paid by the Paid Parental Leave Scheme.

Shift-workers may be entitled to additional annual leave. Check your applicable Award to clarify.
