Community Service Leave

An employee who engages in eligible community service activity is entitled to be absent from employment for a period if the period consists of; time when the employee engages in the activity, travel time associated with the activity, and reasonable rest time immediately following the activity.


Eligible community service includes:

  • Jury service, including jury selection process;

  • Voluntary emergency management activity that;

  • Deals with an emergency or natural disaster; and

  • Is on a voluntary basis; and

  • Where the employee is a member of a recognised emergency management body; and

  • The employee was requested by the body to engage in the activity; or it would be reasonable to expect that, if the circumstances had permitted the making of such a request, it is likely that such a request would have been made.


An employee who wishes to take Community Service Leave must provide notice as soon as is practicable and must advise the expected period of absence. Evidence that would satisfy a reasonable person may be requested.

Community Service Leave is unpaid leave, except for Jury Service.

Casual employees are not entitled to payment for Jury Service.

Unless otherwise agreed, Jury Service will only be paid Jury Service for a period up to 10 working days and payment means an amount paid in relation to jury service under a law of the Commonwealth, a State or a Territory.
